DERMOSKIN DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

1.1. SELLER:

ARTICLE 2 – SUBJECT

The subject of this agreement is the sale and delivery of the product, which the CONSUMER has ordered electronically through the website shop.dermoskin.com.tr, along with its specifications and sales price, and the determination of the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers.

ARTICLE 3 – INFORMATION REGARDING THE PRODUCT, PAYMENT, AND DELIVERY

3.1. Product Information:

3.2. Payment Method: Bank Transfer/EFT or Credit Card/ATM Card.

3.3. Regarding Installment Sales: Since installment sales can only be made with bank-issued credit cards, the CONSUMER agrees to confirm the relevant interest rates and default interest information with their bank and acknowledges that provisions regarding interest and default interest will be applied under the credit card agreement between the bank and the CONSUMER, in accordance with the applicable legislation.

3.4. Return Procedure:

  • a) Credit Card Payment Return Procedure:

    If the purchase was made with a credit card and in installments, the CONSUMER will receive the refund in installments from the bank. After the SELLER pays the full product price to the bank in a single payment, the bank will refund the installment amounts to the CONSUMER's credit card. The CONSUMER agrees to this procedure.

  • b) Bank Transfer/EFT Payment Return Procedure:

    In case of a return, the CONSUMER's bank account information will be requested, and the refund will be made to the specified account via bank transfer or EFT. The CONSUMER agrees to this procedure.

3.5. Delivery Method and Address:

Packaging, shipping, and delivery costs are borne by the CONSUMER and are added to the total order amount. The product price does not include these costs. Delivery will be made to the CONSUMER's address via the contracted cargo company. If the CONSUMER is not present at the address at the time of delivery, the SELLER will be considered to have fulfilled the delivery obligation. The SELLER is not responsible for any damages or costs arising from the CONSUMER's delayed or non-receipt of the product.

ARTICLE 4 – RIGHT OF WITHDRAWAL

The CONSUMER has the right to withdraw from this Distance Sales Agreement within 14 days without providing any reason and without incurring any penalty. The withdrawal period starts from the day the CONSUMER or a third party designated by the CONSUMER receives the product.

The CONSUMER cannot exercise the right of withdrawal for the following contracts:

  • Contracts for goods that are made to the CONSUMER's specifications or are clearly personalized.

  • Contracts for goods that are liable to deteriorate or expire rapidly.

  • Contracts for sealed goods that are not suitable for return due to health or hygiene reasons, if unsealed after delivery.

  • Contracts for goods which are, after delivery, according to their nature, inseparably mixed with other items.

ARTICLE 5 – GENERAL PROVISIONS

5.1. The CONSUMER declares that they have read and understood the preliminary information regarding the product, including its basic characteristics, sales price, and payment method, and have electronically confirmed this information.

5.2. The product will be delivered to the CONSUMER within 30 days from the date of the agreement, unless otherwise agreed upon.

5.3. If the product is to be delivered to a person or organization other than the CONSUMER, the SELLER is not responsible if the recipient refuses to accept the delivery.

5.4. The SELLER is responsible for delivering the product in good condition, complete, in accordance with the specifications stated in the order, and with any warranty certificates and user manuals, if applicable.

5.5. The SELLER is not obligated to deliver the product if the payment is not made or is canceled in the bank records.

5.6. If the product is delivered and the CONSUMER's credit card is used fraudulently by unauthorized persons, and the bank or financial institution does not pay the product price to the SELLER, the CONSUMER is obliged to return the product to the SELLER within 3 days.

5.7. In case of defective products, the CONSUMER can send the product to the SELLER for repair under warranty. The SELLER will bear the shipping costs for such returns.

5.8. For return transactions, the return section of the invoice sent to the CONSUMER must be filled out completely and signed, and sent back with the product.

ARTICLE 6 – DISPUTES AND COMPETENT COURT

In case of disputes arising from this agreement, the Consumer Arbitration Committees in the CONSUMER's place of residence or where the transaction was made are authorized for disputes up to the value announced by the Ministry of Customs and Trade each year. For disputes exceeding this value, the Consumer Courts in the CONSUMER's place of residence or where the transaction was made are authorized.

By placing an order, the CONSUMER is deemed to have accepted all the terms and conditions of this agreement.
