DERMOSKIN SHOP MEMBERSHIP AGREEMENT

1. Parties

a) Dermosa Sales Marketing Education Services Inc., located at Barbaros Mah. D.Boyu Cad. Almazbak Sok. Varyap 2/A Block, Floor: 30, Apt: 249, Ataşehir / ISTANBUL (hereinafter referred to as “Dermoskin Shop”), which operates the website dermoskin.com.tr.
b) The internet user who becomes a member of the website dermoskin.com.tr (hereinafter referred to as the “Member”).

2. Subject of the Agreement

The subject of this agreement is to define the terms and conditions under which the Member can benefit from the website dermoskin.com.tr, owned by Dermoskin.

3. Rights and Obligations of the Parties

3.1. The Member agrees not to use the dermoskin.com.tr website in any way that violates public order, general morality, causes disturbance or harassment to others, is unlawful, or infringes on the intellectual and copyright rights of others. The Member also agrees not to engage in activities or actions that prevent or complicate others' use of the service (such as spam, viruses, Trojan horses, etc.).

3.2. Dermoskin Shop is not responsible for unauthorized access to Member data or any damages to the Member's software and data. The Member agrees in advance not to claim compensation from Dermoskin Shop for any damages that may occur due to use of dermoskin.com.tr.

3.3. The software and design of dermoskin.com.tr are the property of Dermoskin Shop. Related copyright and/or intellectual property rights are protected by law and cannot be used, acquired, or modified by the Member without permission. Other companies and products mentioned on the website are trademarks of their respective owners and are also protected by intellectual property laws.

3.4. The Member declares and guarantees that the personal and other information provided during registration is accurate under the law and agrees to compensate Dermoskin Shop for any damages arising from the inaccuracy of such information.

3.5. Ideas and opinions expressed, written, and used by Members on dermoskin.com.tr are solely their own and are not connected to Dermoskin Shop. Dermoskin Shop is not responsible for any damages arising from such opinions, whether to third parties or to the Member due to third-party content.

3.6. The Member cannot share the password provided by Dermoskin Shop with any other individual or organization. The right to use the password is solely the Member's. The Member is responsible for all actions taken with their password and for any claims arising from unauthorized use. Dermoskin Shop reserves the right to claim compensation for damages resulting from such use.

3.7. The Member agrees not to access or use other users’ data or software without authorization. The Member is solely liable for any legal or criminal consequences resulting from such actions.

3.8. A Member who violates any of the terms in this agreement shall be personally and legally responsible for such violations and shall exempt Dermoskin Shop from any legal or financial consequences. Dermoskin Shop reserves the right to seek compensation from the Member.

3.9. Dermoskin Shop reserves the right to unilaterally delete a Member’s account and associated files, documents, and data at any time. The Member acknowledges this in advance and accepts that Dermoskin Shop has no liability in this regard.

3.10. The Member agrees to comply with all applicable legal regulations while using dermoskin.com.tr and accepts sole responsibility for any legal or criminal consequences.

3.11. For the improvement and development of the dermoskin.com.tr site, and in accordance with legal regulations, Dermoskin Shop may collect information such as the name of the internet service provider, IP address, date and time of access, visited pages, and the address of the website that directed the user to dermoskin.com.tr.

3.12. Dermoskin Shop may use Members’ personal data to offer better service, improve products and services, and customize site content based on user preferences and interests. Dermoskin Shop reserves the right to log Member activities on the website.

3.13. The Member agrees to receive product and service promotions, advertisements, campaigns, surveys, and other customer satisfaction initiatives from Dermoskin Shop and its affiliated companies, now and in the future.

By registering, the Member consents to the collection, use, sharing, and archiving of personal and shopping behavior data by Dermoskin Shop and its affiliates, even after membership ends unless the Member states otherwise.

The Member also consents to be contacted via internet, phone, SMS, etc., unless explicitly opting out. The Member agrees not to claim any compensation or hold Dermoskin Shop or its affiliates liable for any material or moral damages caused by the collection or use of this data. 3.14. Dermoskin Shop may disclose a Member’s personal information if legally required or in good faith if necessary to comply with legal obligations or protect the rights and property of Dermoskin Shop.

3.15. Dermoskin Shop takes reasonable measures to ensure the site is free from viruses and similar threats. However, users are responsible for using their own antivirus software and protections. The Member acknowledges they bear all responsibility for any harm caused by accessing the site.

3.16. Dermoskin Shop reserves the right to change, remove, or terminate the site content or any services at any time, including deletion of user data.

3.17. Dermoskin Shop may change, update, or cancel the terms of this Membership Agreement without prior notice. Any such changes will be binding from the date of publication.

3.18. The parties agree that Dermoskin Shop's computer records shall be the sole and exclusive evidence in accordance with the Turkish Code of Civil Procedure (HMK).

3.19. Dermoskin Shop is authorized to send informational emails and SMS to the email address and mobile number provided by the Member. By accepting this agreement, the Member consents to receive such messages. The Member can cancel these communications via the contact section of the website.

4. Termination and Disputes

This agreement remains in effect until the Member cancels their membership or Dermoskin Shop terminates it. Dermoskin Shop may terminate the membership and this agreement unilaterally if any term is violated.
Any disputes arising from this agreement shall fall under the jurisdiction of the Courts and Enforcement Offices of Istanbul.

5. Enforcement

By registering as a Member, the user confirms that they have read and accepted all terms of this agreement. This agreement takes effect upon registration and is mutually binding.
