INFORMATION TEXT ON THE PROCESSING OF PERSONAL DATA 

As Dermosa Sales Marketing Education Services Inc. (“Dermoskin”), we attach importance to the protection of personal data of our valued commercial customers and would like to inform you within the scope of the Personal Data Protection Law No. 6698 (“KVKK”). 

In all Personal Data processing activities we carry out, we act in compliance with all obligations and principles stipulated in the relevant legislation, especially KVKK, and we take the necessary security measures to ensure the secure processing of your Personal Data.

1. By what methods do we collect your personal data?

In accordance with KVKK, we collect and process your Personal Data when you contact us through the channels listed below:

• In electronic environment, through our websites related to Dermoskin Brands, other websites managed by Dermoskin or Dermoskin Group Companies (“Websites”), our mobile and other applications and all other online channels belonging to a Dermoskin Group Company (“Media Tools”),

• Through businesses and pharmacies where Dermoskin products are sold in physical environments,

• Through accounts operated on behalf of Dermoskin and Dermoskin Brands on various social media channels in the electronic environment (“Social Media”),

• Correspondence conducted electronically via our e-mail addresses (“E-mail”), short messages (“SMS”) or multimedia messages (“MMS”) sent for other purposes to Dermoskin and the Dermoskin Brand (“Communication Tools”),

• Through our electronic call centers (“Call Center”),

• Through Dermoskin's group companies and business partners, if the transfer conditions are met.

 

2. For what purposes and legal reasons do we process your personal data? 

We process your Personal Data for the purposes and legal reasons listed below, in accordance with the personal data processing conditions and purposes specified in Article 5 of the KVKK:

• Based on the legal reason that processing of personal data of the parties to the contract is necessary, provided that it is directly related to the establishment or execution of a contract;

(i) Providing you with the ordered or purchased products and services, and contacting you when necessary,

(ii) Ability to make purchases and sales in Dermoskin Stores,

(iii) Receiving return requests and carrying out return transactions,

(iv) Providing delivery and shipping services,

• Based on the legal grounds that it is clearly prescribed by law and is necessary for the data controller to fulfill its legal obligations;

(i) Fulfilling official institution requests,

(ii) Providing information to authorized institutions arising from legislation,

(iii) Ensuring compliance with the storage obligations stipulated in the legislation,

(iv) Responding to relevant person applications in accordance with the legislation and carrying out the necessary procedures,

 

• Based on the legal reason that data processing is mandatory for the establishment, exercise or protection of a right;

(i) Receiving, evaluating and concluding your requests and complaints,

(ii) Storing personal data for the general statute of limitations in order to constitute evidence in case of possible disputes that may arise in the future,

Based on the legal ground that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person;

(iii) Carrying out the necessary work and carrying out the relevant business processes by our business units to enable the relevant people to benefit from the products and services offered by Dermoskin, including the sales and marketing activities of our products and services,

(iv) Carrying out the necessary work by our relevant business units and carrying out the related business processes in order to carry out the commercial activities carried out by Dermoskin,

(v) Ensuring the legal, technical and commercial-business security of Dermoskin and the relevant persons who have a business relationship with Dermoskin,

(vi) Monitoring and execution of legal affairs,

(vii) Execution of information security processes,

(viii) Planning and execution of customer satisfaction and corporate communication activities,

(ix) Receiving and evaluating your application for participation in training, competitions, raffles and other events and ensuring your participation,

 

If you give your explicit consent, your data will be processed based on your explicit consent;

(x) It is processed for the purpose of presenting models and opportunities for products and services tailored to you, such as internet advertising, targeting, re-targeting (= targeting and re-targeting), cross-selling, campaigns, opportunities and product/service advertisements, making commercial offers considering your preferences and recent purchases, sending gifts and promotions, other magazines/periodicals and electronic commercial messages (such as campaigns, newsletters, customer satisfaction surveys, product and service advertisements).

 

3. Transfer of Your Personal Data to Third Parties:

Your Personal Data may be transferred to business partners and suppliers from whom we receive services for the purposes of processing, legally authorized public institutions and legally authorized private persons, in accordance with the personal data processing conditions and purposes specified in Article 8 of the KVKK, in accordance with the processing conditions specified in Article 5 of the KVKK.

 

Information obtained by Facebook and shared with Dermoskin:

“We may transfer your personal data to our business partner Facebook within the scope of Facebook features and services offered through our website/mobile applications.” The use of these features and services is subject to the Facebook Data Policy, where you can find detailed information about your privacy rights and setting options.

• As part of your use of our website/mobile application, you can create a membership by logging in through Facebook. By registering in this way, you are deemed to have consented to the sharing of public information in your profile with us.

• You can use Facebook's social plugins. For example, you can "like" or "share" our content via the Facebook platform.

• You can accept cookies (which may also be used as "Facebook Pixels") through our website/mobile application, which help us understand your activities. Through the use of cookies, we also collect information about your device, how you use our services, the purchases you make and the ads you see, and whether you have a Facebook account or are logged in with Facebook.

• By your use of the Facebook features in question;

• Show us advertisements that may be of interest to you on Facebook (or Instagram, Messenger or other Facebook services),

• Your data is collected to enable us to measure and analyze the effectiveness of our website/mobile application and advertisements.

In addition, Google may access your personal data if you use Google advertising services through our website/mobile app. Detailed information about Google's use of your personal data can be found in the Google Privacy & Terms document governing this service and data processing.

 

4. Your Rights Regarding Your Personal Data Arising from KVKK and Our Support as a Data Controller

By applying to Dermoskin in accordance with Article 11 of the KVKK;

• Learning whether your personal data is being processed,

• Request information regarding your personal data if it has been processed,

• To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,

• Knowing the third parties to whom your personal data is transferred, whether domestically or abroad,

• Request correction of your personal data if it is processed incompletely or incorrectly,

• To request the deletion or destruction of your personal data, even if it has been processed in accordance with the law and other relevant legal provisions, if the reasons requiring processing of your personal data are no longer present,

• To request that third parties to whom personal data has been transferred be notified of the correction, deletion or destruction of your personal data,

• If your personal data is analyzed exclusively through automated systems and a result is obtained against you, you have the right to object to this result, and to demand compensation for damages if your personal data is processed unlawfully and you suffer damages as a result. 

In this context, you can submit your requests regarding these rights by filling out the form on our website or by submitting your own request, which meets the requirements set by the Personal Data Protection Authority, to our email address or postal address below, using the methods specified by legislation. Depending on the nature of the request, Dermoskin will process the request free of charge as soon as possible and within 30 (thirty) days at the latest. If additional costs arise for Dermoskin to process the request, Dermoskin may charge the fees set by the Personal Data Protection Authority.
